RE: The tariff classification of hats and aprons from China

Dear Mr. Gonzalez:

In your letter dated April 11, 2016, you requested a tariff classification ruling on behalf of your client, Strategic Distribution, Inc. Four samples were submitted with your letter. The samples will be retained by this office.

Style DC52 is a bib-style apron composed of 65 percent polyester and 35 percent cotton woven fabric. The apron falls below the waist and features an adjustable neck strap and a self tie at the waist.

Style DC57 is a waist apron composed of 65 percent polyester and 35 percent cotton woven fabric. The apron ties at the waist and features two front patch pockets.

Style DC59 is a beanie-style chef’s hat composed of 65 percent polyester and 35 percent cotton woven fabric. The brimless hat has a flat crown and an elasticized back.

Style DC591 is a toque-style chef’s hat composed of 65 percent polyester and 35 percent cotton woven fabric. The brimless hat has an adjustable hook and loop strip closure and keyhole opening in the back.

The applicable subheading for style DC52 will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of man-made fibers: Other.” The rate of duty will be 16 percent ad valorem

The applicable subheading for DC57 will be 6307.90.9889, HTSUS, which provides for “Other made up textile articles, including dress patterns: Other: Other: Other: Other: Other.” The rate of duty will be 7 percent ad valorem.

The applicable subheading for styles DC59 and DC591 will be 6505.00.8090, HTSUS, which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Other: Of man-made fibers: Other: Not in part of braid: Other: Other: Other.” The rate of duty will be 18.7 cents per kilogram plus 6.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
